A Casey man was recently arrested and charged with a felony operating while under the influence offense.

According to court documents, at about 9:30 p.m. November 13th, a Stuart reserve officer requested Chief Dave Reha to respond for a possible OWI suspect at the Stuart Kum and Go. The reserve officer had been called to McDonald’s earlier for the report of a disturbance, and made contact with the described suspect, 63-year-old Charles Lyn Davis. Davis agreed to field sobriety testing, which he failed. While Reha’s preliminary breath test device read an error he noticed a strong odor of alcohol coming from Davis, as well as slurred speech and bloodshot, glassy eyes. Davis admitted several times to drinking alcohol earlier.

Davis was arrested and taken to the Adair County Jail where he consented to a breath test, which resulted in a blood alcohol content level of .170. He is charged with OWI third or subsequent offense, a class D felony, as he had convictions in 2009 in Guthrie County and in 2016 in Union County.
