Charges against a Grand Junction woman were recently dismissed in Greene County District Court.

According to court documents, the Honorable Judge Joel Swanson dismissed all charges, including a felony for distribution of meth and two counts of unlawful possession of prescription drugs and misdemeanors for distribution of marijuana and possession of drug paraphernalia, against 44 year-old Brenda Jean Kennedy.

Swanson granted the defense’s motion to suppress evidence against Kennedy claiming that law enforcement obtained items in an executed search warrant illegally. The search warrant was executed in the 400 block of North 16th Street in Grand Junction on Saturday, August 13th.

The defense argued that the search warrant didn’t list what the executing officer was allowed to look for, but was left blank. The defense claimed the search warrant was in violation of the 4th Amendment of the US Constitution and Judge Swanson agreed and dismissed all charges.
