A Michigan man was arrested in Adair for an alleged incident earlier this month.

According to court documents, at 10:53pm on February 5th an Adair Police Officer observed 40-year-old Brandon O’neill of Whitelake, Michigan, exit the Adair Kum & Go gas station convenience store, and allegedly take a large clear bottle of alcohol from the trunk of his vehicle and pour some into a glass. The officer, along with an Adair County Sheriff’s Deputy, decided to make contact before Oneill started driving.

Court documents show that upon making contact, Oneill told authorities he was going to have the drink before finding a room at one of the hotels in Adair, and that the officer could take the drink and pour it out if he wanted. While speaking with the defendant, the officer could smell an alcoholic beverage, and asked if they could search the vehicle, and Oneill gave permission to do so.

During the search, an alcoholic beverage was found in the front seat cup holder, along with a handgun being found between the driver’s seat and center console. The firearm had a loaded magazine and a round in the chamber. The defendant was then given a field sobriety test and passed a breath test. While running O’neill’s information, it was discovered that he was a convicted felon. He was then arrested and transported to the Adair County Sheriff’s Office and booked for a Class D Felony for a felon in possession of a firearm.
