A Minburn man is serving two years of probation after pleading guilty to a lesser charge for a 2023 incident.
According to court documents, 47-year-old Jason Spence pled guilty to a lesser charge of an aggravated misdemeanor for third degree theft. He had a two year prison sentence suspended and was placed on probation for two years with the Iowa Department of Corrections.
The charge stemmed after the Dallas County Sheriff’s Office conducted an investigation in October of 2023 and they found that Spence took a truck from a victim that the victim thought that Spence was getting it repaired from a business. Court documents show that Spence never took the truck to get repairs and the victim paid Spence for what the victim was told were the repair costs of $3,500.
Court documents show that the Dallas County Attorney’s Office filed an agreement with Spence that in order to pay the restitution of $95,845, he will pay at least $50 monthly. As per the plea agreement, Spence pled guilty to the lesser aggravated misdemeanor from the original Class D Felony charge of second degree theft.
